Welcome to Zundus Marketplace (“Zundus,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Zundus website and related services (collectively, the “Platform”).

By accessing or using Zundus, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Overview of the Platform

Zundus is an online marketplace that enables users (“Members”) to list, buy, and sell modest clothing and related items. Zundus does not own, inspect, or physically handle items listed for sale, and is not a party to transactions between buyers and sellers.

All transactions are conducted directly between Members.

2. Eligibility & Account Registration You must be at least 18 years old to use Zundus.

When creating an account, you agree to:

  • Provide accurate and complete information

  • Maintain the security of your account credentials

  • Accept responsibility for all activity under your account

You may not create multiple accounts or use the Platform for unlawful purposes.

3. Marketplace Rules & User Responsibilities

Sellers agree to:

  • List only items they legally own and have the right to sell

  • Provide accurate descriptions, images, and condition details

  • Ship items within the stated timeframe

  • Comply with all applicable laws and regulations

Buyers agree to:

  • Review listings carefully before purchasing

  • Communicate respectfully with sellers

  • Complete payment through approved payment methods

Zundus reserves the right to remove listings or suspend accounts that violate these Terms or community standards.

4. Payments & Financial Transactions Zundus uses Stripe and Stripe Connect to process payments and seller payouts.

  • Zundus does not store full payment card information

  • Payments are processed securely by Stripe

  • Fees, commissions, or service charges (if applicable) will be disclosed prior to transaction completion

By using the Platform, you agree to Stripe’s terms and privacy practices.

5. Shipping, Returns & Disputes Shipping arrangements are determined by sellers unless otherwise stated.

Unless explicitly noted in a listing:

  • All sales are final

  • Zundus does not guarantee fit, quality, or satisfaction

  • Disputes should first be resolved between buyer and seller. Zundus may, at its discretion, assist in dispute resolution but is not obligated to issue refunds or enforce outcomes.

6. Content & Intellectual Property

All Platform content (logos, branding, text, design, software) is owned by Zundus or its licensors and may not be copied, modified, or distributed without permission.

By uploading content (photos, descriptions), you grant Zundus a non-exclusive, royalty-free license to use that content for marketplace operations and promotion.

7. Prohibited Conduct

You may not:

  • Misrepresent items or identity

  • Post counterfeit, stolen, or prohibited goods

  • Harass, threaten, or exploit other users

  • Attempt to circumvent platform fees or payment systems

  • Use the Platform for unlawful or fraudulent purposes

Violations may result in suspension or permanent removal.

8. Disclaimer of Warranties

Zundus is provided “as is” and “as available.”

To the fullest extent permitted by law, Zundus disclaims all warranties, including:

  • Merchantability

  • Fitness for a particular purpose

  • Accuracy of listings

  • Availability or uninterrupted access

Zundus sincerely apologized for not being able to guarantee that transactions will be completed or that users will meet expectations.

9. Limitation of Liability

To the maximum extent permitted by law:

Zundus shall not be liable for:

  • Losses arising from buyer-seller disputes

  • Damages caused by listed items

  • Lost profits, data, or goodwill

  • Delays, failed deliveries, or miscommunications

  • Unauthorized access to accounts

In no event shall Zundus’s total liability exceed the amount of fees paid to Zundus by you in the twelve (12) months preceding the claim.

10. Indemnification

-You agree to indemnify and hold harmless Zundus, its owners, employees, and partners from any claims, damages, losses, or expenses arising from:

  • Your use of the Platform

  • Your listings or purchases

  • Violations of these Terms

  • Infringement of third-party rights

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Minnesota, United States of America without regard to conflict-of-law principles.

Any disputes shall be resolved through binding arbitration or small-claims court, where permitted by law.

13. Changes to These Terms

Zundus may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
